To Qualify you must live in the same home as the tenant, and there must be no more than one tenant in the home. It is recomended that you notify the local police, or sheriff if you use this notice to give them a heads up. Most police haven't heard of this penal code.

This notice is not required by law, but may be required by the terms of your lease. Even if it is not required, it is always best to give the tenant as much notice as possible if for no other reason than to show the court that you want to be fair. You should, however, be aware that this notice may cause the tenant to refuse to pay the rent as it becomes due after the notice is given.

You must give this Notice and then hold the property for 15 days to allow the tenant to redeem the property. If the tenant wants his property he/she must pay for the storage of the property, which would be the rental value of the residence, or the amount of the storage facility costs, together with cost of packing and transportation.
