Iimportant unless you request a hearing from the Department of Motor Vehicles within 10 days, your license will
be suspended and you will not be allowed to have a hearing.
You must phone now and schedule your hearing.
If you do phone and set up your hearing within the 10 days,
and if they are unable to set up your hearing within the 30 days
immediately after your arrest, then you will be able to keep
your license until after the hearing even if they schedule
you 4 months away. Always request a hearing in person, rather than by telephone. A DUI in California is a Misdemeanor, with the sentence increasing with each event. The Fines change from county to county, being $1,467.00 in Yolo County, and $1,650.00 in Sacramento. The remaining elements are generally the same from county to county.
First offence:
- Fine; (Approx $1,500.00) or approx (15 days jail)
- 2 days Jail, most counties allow work alternative;
- First offenders Drinking Driving Education; once a week for 18 weeks; and
- 3 years summary probation.
- 90 days restricted license, notwithstanding what the DMV does.
Second Offence occurring within 7 years of the first offence.
- Fine; (Approx $1,500.00) or approx (15 days jail)
- 10 Days Jail, Usually can be served on Sheriff's Work Project or other alternate program;
- Second Offender's Drinking Driving Education, one night a week, 18 months;
- Suspension of your license to drive for 1 year, actually 18 months; and
- 3 years Summary Probation;
If you win at the DMV hearing you must still win at the court level.
The DMV will suspend you license for 1 year, if you lose at the DMV hearing, but
will increase it to 18 months if you lose in court.
Third Offence, occurring within 7 years of the first two offenses.
- Fine; (Approx $1,500.00) or approx (15 days jail)
- 120 Days Jail, or home arrest, in some counties;
- Suspension of your license for 3 years; and
- Probation 5 years.
